An on-duty meal period waiver form will permit your employee to waive the requirement that meal periods take place duty-free, meaning, uninterrupted.
► When To Use an On Duty Meal Period Waiver
There may be times and circumstances where it is not possible for employees to be totally relieved of duties when taking meal periods. An on-duty meal period waiver form will allow your business and employee to agree that the employee is waiving their rights to an unpaid 30 minute meal period that is uninterrupted and may take place at the location of the employee’s choosing. As a result, the employee will stay at the premises during the meal period and will eat their meal at work and will be paid during the meal period.
It is important to have a written document that you use for an employee’s agreement to waive a meal period and agree to an on-duty meal period waiver because waivers are not effective unless they are in writing and signed by the employee as well as his/her supervisor.
